These Terms & Conditions ("Terms") govern your use of HIBIKI (the "Service"), operated by Hibiki ("we", "us"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 13 years old (or 16 in the European Economic Area) and able to form a binding contract in your jurisdiction. If you use the Service on behalf of an organization, you represent that you are authorized to accept these Terms for it.

2. The Service

HIBIKI is a tool that translates images you provide: it detects text, removes it, reconstructs the artwork behind it, and renders a translation. HIBIKI does not host, publish, or distribute any content, and provides no library of works. We may change, suspend, or discontinue any part of the Service at any time.

3. Your content and your responsibility

You are solely and entirely responsible for the images and text you upload and for the results you generate ("Your Content"). You represent that you have the rights necessary to use Your Content with the Service and that doing so does not violate any law or third-party right.

Your Content is processed to provide the translation and then stored on your own device (in your browser) for a limited time. We do not persistently store your uploaded images on our servers (content may be held briefly in server memory while your job is processed). You grant us only the limited, temporary license needed to process Your Content and return the result to you. We do not review, endorse, or moderate Your Content.

4. Acceptable use

You agree not to use the Service to:

• upload, generate, or process any content that is illegal, including child sexual abuse material (CSAM) or any depiction of minors in a sexual context;
• infringe the intellectual property or other rights of others beyond your own lawful, personal use;
• abuse, overload, reverse-engineer, scrape, or attempt to bypass limits, quotas, or security of the Service;
• resell or commercially redistribute the Service or its output.

Some features (such as page quotas and retouch operations) are subject to fair-use limits designed to keep the Service fast for everyone; normal use will not run into them.

We may suspend or terminate any account, and remove access, at our discretion — in particular for illegal content or abuse — and we will cooperate with valid legal requests.

5. Intellectual property

All series, characters, and artwork you process belong to their respective creators and rights holders. The Service is intended for personal use. The HIBIKI software, brand, and site are owned by us; these Terms grant you no rights to them beyond using the Service as provided.

6. Payments, subscriptions and refunds

Paid plans (Pro subscriptions and one-time page packs) are sold and processed by our payment provider, Paddle, acting as Merchant of Record. Subscriptions renew automatically until cancelled; you can cancel at any time and keep access until the end of the current period. Refunds are governed by our Refund Policy.

7. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied. Machine translation and image reconstruction may be inaccurate or incomplete; you use the output at your own risk. We do not warrant that the Service will be uninterrupted or error-free.

8. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages, or for Your Content or your use of the Service. Our total liability for any claim is limited to the amount you paid us in the three (3) months before the event giving rise to the claim.

9. Indemnification

You agree to indemnify and hold us harmless from any claim or demand arising out of Your Content or your use of the Service in breach of these Terms or the law.

10. Termination

You may stop using the Service at any time. We may suspend or terminate your access as described in these Terms. Provisions that by their nature should survive termination (e.g. ownership, disclaimers, limitation of liability) will survive.

11. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date above reflects the current version; continued use after a change means you accept it.

12. Governing law

These Terms are governed by the laws of Chile, and any disputes will be subject to the courts of Chile, without regard to conflict-of-law rules.
